Service
1.1 The self-service ordering service is for personal and non-commercial use only. 1.2 The One Dim Sum Self-Service Ordering Service allows users to place orders online by scanning a QR code and making payments to One Dim Sum through the platform. If self-pickup is chosen, users need to go to the corresponding One Dim Sum to collect the food. 1.3 BOXS only provides the platform as a medium for you and One Dim Sum to complete the online ordering and payment process for mobile ordering and does not guarantee or assume responsibility for the food provided. Fulfilling your order is the responsibility of One Dim Sum. 1.4 BOXS has no authority to accept legally binding responsibilities on behalf of you or One Dim Sum under any circumstances. 1.5 BOXS will not be liable for any actions or omissions of One Dim Sum (including insufficient service, incorrect meals or prices, quality of food or beverages, exceeding the required time to prepare orders, etc.). 1.6 When you submit a mobile order for self-pickup through the platform and complete the payment, the order will be sent directly to the corresponding participating restaurant. Once One Dim Sum accepts your order, a sales contract between you and One Dim Sum is formed. One Dim Sum will display the estimated time to prepare your meal on the platform. If you choose self-pickup, please collect your meal from One Dim Sum at the estimated time. 1.7 You are responsible for ensuring that the information you fill in on the platform for delivery services, such as contact person, delivery address, and phone number, is correct so that One Dim Sum and third-party delivery service providers can communicate with you regarding any issues with the order or meal. 1.8 If you choose self-pickup but fail to collect the meal from One Dim Sum within 120 minutes after the estimated time, you agree to forfeit the right to collect the ordered meal and are not entitled to any refund for the ordered meal. 1.9 All meal supplies are subject to availability. One Dim Sum may provide substitutes for any meals that cannot be provided after confirming the order and will notify you by phone. If you do not accept the substitute, One Dim Sum will refund the cost of the relevant meal to the credit card, debit card, or other payment platform you used to pay for the order. 1.10 If you have any food allergies, you should contact One Dim Sum before placing an order for delivery or mobile ordering. One Dim Sum will not be responsible if any food you order does not meet your dietary or other requirements and restrictions. 1.11 BOXS will not be responsible for the quantity, quality, taste, or freshness of any food. 1.12 Alcoholic beverages can only be sold to users aged 18 or above. By ordering delivery or mobile ordering that includes alcohol, you expressly declare and warrant that you are at least 18 years old and will present your Hong Kong identity card to verify your age upon reasonable request by One Dim Sum staff.
Cancellation and Returns
2.1 If you need to cancel your order after placing it and completing the online payment, you must notify One Dim Sum by phone as soon as possible and provide your delivery order number. If One Dim Sum accepts your cancellation, you can negotiate a refund of your meal cost with One Dim Sum. If the meal is already being prepared, has been handed over to a third-party delivery service provider, or has been delivered, the order cannot be canceled, and the meal cost and delivery fee will not be refunded. 2.2 One Dim Sum reserves the right to cancel any order. In this case, you will be notified on the platform. The amount you paid for the order will be refunded to you within 14 days using the same method you used to pay for the order. 2.3 All food sold through the platform cannot be changed or returned by you for a refund. 2.4 No fees will be charged for any orders canceled under these Terms.
Prices and Payment Methods
3.1 The price of each meal will be displayed on the platform. All listed prices are subject to change, but these changes will not affect any orders you have placed through the platform. 3.2 Users should make full payment for the ordered meals using the credit card, debit card, or electronic wallet specified on the platform.
Liability
4.1 To the maximum extent permitted by law, One Dim Sum will not be liable for any direct, indirect, special, or consequential loss or damage arising from your use or inability to use the self-service ordering service, whether in contract, tort (including but not limited to negligence), or otherwise. 4.2 In any case and subject to applicable law: (a) One Dim Sum’s total liability to you for all claims and expenses arising from or related to your use of the self-service ordering service is limited to the meal cost you paid for the order. (b) One Dim Sum will not be liable if the platform is unavailable or inoperable at any time or for any period.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”). Both parties hereby submit to the non-exclusive jurisdiction of the Hong Kong courts, but these Terms may be enforced in any court of competent jurisdiction.
